LAS VEGAS - Private messages contained in two MySpace.com accounts cannot be used by a company to defend against a woman's sexual harassment claims but could demonstrate whether the alleged emotional distress caused by the behavior led to the woman's suicide attempts, a federal magistrate judge ruled Jan. 9 (Maria Mackelprang v. Fidelity National Title Agency Of Nevada Inc., et al., No. 06-CV-788-JCM-GWF, D. Nev.; 2007 U.S. Dist. LEXIS 2379).

Law firms everywhere are following a trend to make their lengthy, sometimes tongue-twisting names more palatable -- and more memorable. Patrick C. Dunican Jr., the managing director for Gibbons, which until last week was Gibbons Del Deo Dolan Griffinger & Vecchione, says that to stick with five names in a firm is anachronistic -- a point echoed by legal consultants. But shortening a name, particularly at small to midsize firms or at firms where name partners are still members, can be a touchy issue.

WASHINGTON, D.C. -- The U.S. Supreme Court agreed Jan. 19 to review a federal appeals court ruling that allows a company that undertook a voluntary cleanup to pursue cost recovery claims under Comprehensive Environmental Response, Compensation and Liability Act Section 107 (United States of America v. Atlantic Research Corp., No. 06-562, U.S. Sup.).

The convergence over the past five years of litigation involving drugs such as Baycol, Propulsid and Rezulin has resulted in a steady increase in the amount of drug cases reported by major drug companies, according to statistics compiled by LexisNexis. But the increase has slowed slightly as litigation matures and as drug companies begin to settle, the figures indicate.

WASHINGTON, D.C. - The U.S. Supreme Court announced Dec. 12 that it will review an appellate decision that a tobacco company correctly invoked federal officer removal jurisdiction when it brought the case before an Arkansas federal court; the high court granted review despite the federal government's negative endorsement (Lisa Watson, et al. v. Philip Morris Companies, Inc., et al., No. 05-1284, U.S. Sup.; See August 2005, Page 6).

It's been nearly 16 years since the Americans with Disabilities Act went into effect. Lawyers with disabilities say it's still tough to get big-firm jobs, despite the ADA and despite advances in technology that help them handle legal work. "Most attorneys who are blind or visually impaired work for the government or work in solo practice," says Chris Prentice, a solo in Texas who is legally blind. Prentice says he would like to leave solo practice and work at a firm for financial reasons.

New patent case filings in federal court increased by 4.2 percent between 2002 and 2003, continuing the upward trend that has resulted in a 130 percent increase in patent case filings from 1988 to 2003, according to a report released by LexisNexis.
