If the current trend continues, there will again be fewer insurance cases filed in federal court this year than in 2003 and 2002, according to a report by LexisNexis. There were 3,991 cases in which "insurance" is the nature of suit filed in federal courts in the first half of 2004. That compares with 4,298 for the first half of last year and 4,463 in the first half of 2002.

A New York attorney has vowed to appeal a federal judge's denial of his
challenge to his arrest for possession in his home of two "chuka
sticks," or "nunchaku." James M. Maloney called the statute that
prohibits possession of the weapon "nothing less than draconian." But
U.S. District Judge Arthur Spatt made short work of the claim that New
York's Penal Law violated Maloney's First Amendment right of free speech, his Second Amendment right to keep and bear arms and his Ninth Amendment right to privacy.

A senior Pentagon official resigned last week over controversial remarks in which he criticized lawyers who represent terrorism suspects, the Defense Department said. Charles "Cully" Stimson, deputy assistant secretary of defense for detainee affairs, drew outrage from the legal community for a radio interview in which he said he was shocked that lawyers at many top law firms represent Guantanamo Bay detainees and suggested they were not doing the work pro bono but "receiving moneys from who knows where."

A second round of wine-related litigation is fermenting across the nation, challenging state shipping laws that limit direct sales to consumers. New suits and amended complaints are attacking requirements that consumers buy wine in person, and wineries are challenging shipping limits based on production volume. The recent suits put a new twist on the direct-shipping issues that prompted a recent U.S. Supreme Court ruling which found that New York and Michigan discriminated against out-of-state wineries.

The president of the Lesbian, Gay, Bisexual & Transgender Law Association has resigned over comments he made to the press about a Sullivan & Cromwell associate's sexual-orientation discrimination suit against the firm. GULFPORT, Miss. -- A federal judge on Jan. 31 reduced a jury's award of $2.5 million in punitive damages to $1 million on the basis that a $1 million award against State Farm Fire & Casualty Co. for denying a Mississippi couple's claim for damages after their home was destroyed by Hurricane Katrina is more appropriate (Norman and Genevieve Broussard v. Just because a number of large law firms recently offered $160,000 salaries to first-year associates doesn't mean lawyers can't be persuaded to join smaller firms. According to surveys, the majority would take less money for more free time, and midsize firms are using that to their advantage when soliciting top associates. The motivations of attorneys are also different, with first-years concerned about paying off student loan debt and midlevels more focused on the type of environment the firm fosters.

The convergence over the past five years of litigation involving drugs such as Baycol, Propulsid and Rezulin has resulted in a steady increase in the amount of drug cases reported by major drug companies, according to statistics compiled by LexisNexis. But the increase has slowed slightly as litigation matures and as drug companies begin to settle, the figures indicate.

California associates still dreaming of New York-sized salaries are in
for a rude awakening. West Coast standard bearers Latham & Watkins and
Gibson, Dunn & Crutcher announced that they're increasing first-year
associate pay to $160,000 in New York, but only to $145,000 in
California and elsewhere. Orrick, Herrington & Sutcliffe, Heller Ehrman
and Paul, Hastings, Janofsky & Walker also announced the same increase -- except that Orrick will also raise Washington, D.C., first-years to the $160,000 scale.

New patent case filings in federal court increased by 4.2 percent between 2002 and 2003, continuing the upward trend that has resulted in a 130 percent increase in patent case filings from 1988 to 2003, according to a report released by LexisNexis.
